1. Agreement to Terms

By engaging Lutz AI for any services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not engage our services. These terms apply to all clients and prospective clients of Lutz AI.
2. Services Provided
​
Lutz AI provides AI-powered business automation services to small and mid-sized businesses. Services may include, but are not limited to:

Missed call text-back automations

Lead follow-up automation workflows

Appointment confirmation and reminder sequences

Lead tracking pipeline setup and management

Customer review request automations
The specific services delivered to each client will be outlined in a separate service agreement or proposal prior to the start of work.
3. No Guarantee of Results

Lutz AI makes no guarantee of specific outcomes, revenue increases, lead volumes, or business growth as a result of our services. Automation tools and workflows are implemented in good faith based on best practices, but results may vary depending on factors outside of our control, including the nature of your business, market conditions, and how your team utilizes the systems we put in place.
4. Client Responsibilities

As a client of Lutz AI, you are responsible for:

Providing accurate and complete information necessary to build and configure your automation systems

Ensuring you have the legal right to contact the customers and leads in your database

Complying with all applicable laws and regulations, including CAN-SPAM, TCPA, and any other laws governing electronic communications

Maintaining your own business accounts, subscriptions, and tools that integrate with our automations
5. Payment Terms

Services are billed on a monthly retainer basis unless otherwise agreed upon in writing. Payment is due at the beginning of each billing cycle. Lutz AI reserves the right to pause or discontinue services if payment is not received within 7 days of the due date. All fees are non-refundable except as outlined in our Refund Policy.
6. Ownership of Work & Data

All data, customer lists, and business information provided by the client remain the sole property of the client. Lutz AI will not sell, share, or use your business data for any purpose outside of delivering your agreed-upon services. Any automation workflows, templates, or systems built specifically for your business are licensed to you for use during the duration of your engagement with Lutz AI.
7. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. Lutz AI will not disclose your business information, systems, or strategies to any third party without your written consent, except where required by law.
8. Limitation of Liability
​
Lutz AI's total liability to any client for any claim arising out of or related to our services shall not exceed the total amount paid by the client in the most recent 30-day billing period. Lutz AI shall not be liable for any indirect, incidental, or consequential damages, including lost revenue or lost business opportunities.
9. Termination
​
Either party may terminate the service agreement with 30 days written notice. Upon termination, Lutz AI will provide a transition summary of all active automations and workflows so that you can maintain continuity in your business operations.
10. Changes to These Terms
​
Lutz AI reserves the right to update these Terms and Conditions at any time. Clients will be notified of any material changes at least 14 days in advance. Continued use of our services following notice of changes constitutes acceptance of the updated terms.
